I will always do my best to fulfil your needs and meet your expectations, but it’s important to have things written down so that we both know what’s what, who should do what and when, and what will happen if things go wrong. In these terms and conditions you won’t find any complicated legal jargon or long passages of unreadable text. I've no desire to trick you into something that you might later regret. What I do want is what’s best for both parties, now and in the future.
You are hiring me to undertake work outlined within the subscription level you have selected. Before you are able to sign up you will be asked to confirm you have read and agree to the terms and conditions set out below.
Me:
I have the experience, skills and ability to do everything I have agreed to do, and I will do it all in a professional and timely manner. I will endeavour to meet any deadline that’s set and on top of that I will maintain the confidentiality of all information you supply to me.
You:
You have the authority to enter into this agreement on behalf or yourself, your company or your organisation. You will endeavour to supply all the information I need from you in order to complete the work, and you will review completed work and provide feedback in a timely manner.
I will create designs and layouts which are unique to the project. I won't use third party templates or themes. I will use modern techniques and fully licensed and up to date software to produce designs in industry standard formats.
You will have opportunities to review my work during the design process which can be arranged with suitable notice or planned in advance. On agreement I can meet at your offices or place of business, or, alternatively I can provide updates and design proofs over Email, which is usually the preferred method.
You should supply graphic files in an editable vector format such as PSD, Ai or PDF. You should supply any photography in a high resolution digital format preferably JPG. If the photography you supply is not of suitable quality to be included within the design I will notify you of this and offer to supply suitable stock photography or recommend a professional photographer in your local area.
I create websites using HTML5 and CSS3 and use Javascript for interactivity, animation and effects. If these technologies are not supported by a browser or have been blocked by the user the website may not function as intended.
I use Kirby or Craft CMS for content management. Both are modern applications that are fast, secure and easy to use. I offer unlimited help and support, over the telephone or via email, and I will always keep CMS software fully up to date and secure.
I will test all my work in major desktop and mobile browsers including Safari, Chrome, Firefox and Edge. I can also support some legacy browsers such as Internet Explorer. If older browser support is required please inform me of this before signing up.
I offer content and design layout updates within the scope of your current subscription level. You can send me new content over email and I will make these updates as soon as possible. For simple amendments this is usually within 24 hours. During busy periods or for more involved changes I will advise of a timescale at the point of request. On the Pro plan you can also make most changes to existing content yourself through the a content management system.
I will host your website files and supply data transfer and storage of these files. I offer unlimited data transfer and storage, although, if your website traffic negatively effects other users within the system I may request alternative hosting arrangements which may include an additional fee.
I will take a daily backup of your website files and databases and keep these files for 7 days. I will also take a monthly backup of your website files and databases and keep these files for 12 months.
I will manage and renew domain names associated with your account. The domain names can be any of the following:
Alternatively you can choose to register and manage your own domain name, and simply point this at the server where your website files are hosted.
I will host one or more email accounts within the scope of your current subscription level. I will provide Email account details for access through third party email applications, and also supply access through a web based email client. Email hosting can not be provided for domain names managed through third party registrars.
To preserve privacy I do not store backups of your emails. It is advised you download or backup any important emails through your email application on a regular basis.
You guarantee that all elements of text, images or other artwork you provide are either owned by yourselves, or that you have permission to use them.
After your subscription has been active for 12 months, you will own the combined visual design that I have created for your project, the finished and complete design only. If required I can supply these designs in a format suitable for another agency or developer to work from.
I will own the code used within the website and will licence this to you for the duration of your subscription and for this project only.
Deadlines may be put into place at any point while your subscription is active. They can change, slip or be brought forward but must be agreed on by both parties to come into effect. Any deadline not agreed by us both will be disregarded and will not effect any part of this agreement. I will do my best to stick to any deadlines we have agreed, but will not be held responsible for any damages or losses incurred from a deadline not being held.
All payments are requested automatically through a monthly direct debit managed by our secure payment provider - GoCardless.
There's no minimum contract and you are free to cancel your subscription at any time and for any reason. However, if you would like to continue to use the visual design I have created you must have an active subscription for at least 12 months. If you are leaving after this period I can supply the designs used in a format suitable for another agency or developer to work from.
I can’t guarantee that my work will be error free and so I can’t be liable to you or any third party for damages, including lost profits, lost savings or other incidental, consequential or special damages, even if you have advised me of them.
If any provision of these terms shall be unlawful, void or for any reason unenforceable, then that provision shall be deemed severable and shall not effect the validity and enforceability of any remaining provisions.
The act of signing up to one of my monthly website packages and activating the associated direct debit instruction will be taken as confirmation that you have read and agree to the above terms and conditions.
